An injury caused by someone else’s carelessness starts deadlines most people in Tampa never hear about until it is too late. If a vehicle was involved, Florida gives you 14 days to see a doctor before your own insurance benefits vanish. For almost every injury claim in this state you now have two years to file suit, not the four years older guidance still repeats.

Our attorneys handle the full range of injury and muerte por negligencia claims across Hillsborough County and Tampa Bay from our office on East Jackson Street downtown. We have represented injured Floridians since 1988, recovered billions for our clients, and we charge no fee unless you recover money.

Puntos Clave

  • After a motor vehicle crash, Florida’s 14 day rule means you must be seen by a qualified medical provider within 14 days or you forfeit your PIP benefits entirely.
  • Florida’s permanent injury threshold applies only to motor vehicle claims. If you were hurt in a fall, by a defective product or by a negligent doctor, no threshold stands between you and a claim for pain and suffering.
  • Since 2023, being found more than 50 percent at fault ends your claim completely. Negligencia médica is the one exception and still uses pure comparative negligence.

This needs saying plainly because a large amount of inaccurate information is circulating. Repeal bills including Senate Bill 522 and House Bill 769 both died in committee, the 2026 session ended on March 13, 2026 without a repeal, and an earlier repeal bill was vetoed in 2021. Every Florida driver still carries the $10,000 minimum PIP coverage required since 1971, and your own policy is still the first place your medical bills go regardless of who caused the crash.

The 14 day rule, and why it costs Tampa drivers so much money

Under Florida Statute section 627.736, you must obtain initial medical treatment from a qualified provider within 14 days of a motor vehicle accident to be eligible for PIP benefits at all. The clock runs continuously. Weekends count. Holidays count. There is no extension because a provider could not fit you in, and no exception because you felt fine at the scene.

This is the most common way people injured in Tampa crashes lose money they were entitled to. Soft tissue injuries and concussions frequently produce no symptoms for days. People wait, and by the time they see a doctor on day 17 the benefit is gone. Get evaluated in the first few days even if you believe you are uninjured.

Seeing a doctor inside 14 days keeps you eligible. It does not unlock the full benefit. For that, a qualifying provider must determine you suffered an emergency medical condition. Florida Statute section 627.732 defines that as acute symptoms severe enough that the absence of immediate medical attention could reasonably be expected to result in serious jeopardy to your health, serious impairment to a bodily function, or serious dysfunction of a bodily organ or part.

Without that finding, your PIP benefits are capped at $2,500. That $7,500 difference turns on how your treatment is recorded in the first two weeks, which is why an attorney should be involved early rather than after the bills arrive.

When can you step outside no-fault and sue the driver who hit you?

PIP covers your economic losses up to the $10,000 PIP maximum. It does not pay for pain, suffering, mental anguish or inconvenience. To recover those from the at fault driver, your injury has to clear the permanent injury threshold. Florida Statute section 627.737(2) allows non-economic damages in four situations:

  • Cicatrices o desfiguraciones significativas y permanentes
  • Muerte

Temporary pain, however genuine, does not clear the threshold. Whether you meet it is a medical question answered by your records, and defense lawyers attack it aggressively. Building that record from the first appointment forward is a large part of what we do on a Tampa accidente de automóvil, Reclamación.

One point gets lost constantly: this threshold applies to motor vehicle claims only. If you were injured in a fall, by a defective product, by a seguridad negligente failure or by a medical error, no threshold and no PIP layer sits between you and the at fault party. People read the motor vehicle rule, assume it covers every injury in Florida, and never call anyone. That assumption costs them the claim.

Who can be held responsible for your injury in Tampa?

The obvious defendant is frequently not the only one, and frequently not the one carrying meaningful coverage. Commercial, municipal and corporate policies carry far higher limits than an individual’s, and that difference often decides what a case is worth.

Tampa Bay produces liability questions that do not come up everywhere. Port Tampa Bay and the freight corridors feeding it put heavy truck volume onto I-75, I-4 and the routes connecting them, which brings motor carriers, freight brokers and shippers into the picture alongside the driver. The Selmon Expressway, the Howard Frankland Bridge and the Gandy Bridge concentrate high speed traffic into constrained corridors, Dale Mabry Highway and Hillsborough Avenue mix heavy volume with constant pedestrian activity, and event and tourist swings add drivers unfamiliar with all of it.

Parties we routinely investigate in Hillsborough County claims:

  • A vehicle owner who is not the driver, including employers and fleet owners
  • A trucking company, freight broker or shipper where a commercial vehicle was involved
  • An employer, where the at fault person was working at the time
  • A property owner, tenant, manager or maintenance contractor in a premises case
  • A manufacturer or distributor of a defective product or component
  • A bar or restaurant that over served a driver later involved in a crash
  • A hospital, practice group or staffing entity in a medical negligence case
  • A government agency, including where a HART bus or other publicly owned vehicle was involved, or where a hazardous road condition or defective signal contributed

Claims against a government entity carry their own notice deadlines, shorter and stricter than an ordinary claim. These get missed often, and missing one ends the claim regardless of fault.

Yes, and since 2023 the consequences are more severe than most people realize. Florida applies modified comparative negligence with a 51 percent bar. If you are found more than 50 percent responsible, you recover nothing at all. At 50 percent or less you can recover, with damages reduced by your percentage of fault. A $200,000 award with a 30 percent fault finding pays $140,000.

Before House Bill 837, Florida used pure comparative negligence and an injured person could recover something even if mostly to blame. Every insurance company now has a direct financial incentive to build a fault percentage against you, because pushing you past 50 percent eliminates their exposure entirely.

There is one important exception. Medical malpractice claims are carved out of the 51 percent bar and still run on pure comparative negligence. In a Negligencia médica case, a finding that you were substantially responsible reduces your recovery but does not extinguish it. That distinction is missed constantly.

Whichever rule applies, never accept an insurer’s assessment of fault, never give a recorded statement before speaking to an attorney, and never treat a police report as final.

How long do you have to file an injury lawsuit in Florida?

Two years from the date of the injury for negligence claims that accrued after March 24, 2023. House Bill 837 cut this deadline in half. It was four years for decades, and a great deal of outdated guidance still says four years. Relying on that is catastrophic, because once the statute of limitations expires your right to pursue the claim is gone permanently no matter how strong the evidence is.

Two years is less time than it sounds once a case is being built properly. Records have to be gathered, experts retained and liability investigated before anything is filed. Medical malpractice claims carry pre-suit requirements that consume months on their own, and wrongful death and government claims run on shorter timelines again.

What types of injury cases do we handle in Tampa Bay?

Accidentes de coche y de tránsito

This is the largest part of our Tampa practice and where Florida’s insurance rules bite hardest. We handle rear-end and intersection collisions, head-on crashes, rollovers, hit-and-run cases, drunk and distracted driving claims, pileups on I-275 and I-4, uninsured motorist claims and accidentes de viaje compartido. Every one runs through PIP, the 14 day rule, the emergency medical condition determination and then the permanent injury threshold. Our Abogados de accidentes automovilísticos en Tampa handle that sequence from the first phone call.

Port Tampa Bay and the freight network around it mean Hillsborough County sees a heavy share of commercial traffic, and a collision with a tractor trailer is a different case from a collision with a car. Federal motor carrier regulations apply, hours of service logs and electronic data matter, and the evidence that decides the case can be overwritten within days. Our Abogados de accidentes de camiones en Tampa preserve it immediately.

Accidentes de moto

Riders are exposed in ways drivers are not, and insurers exploit that with arguments about rider behavior before the file is open. Florida’s PIP requirement does not extend to motorcycles the way it does to cars, which changes the coverage analysis and surprises most injured riders. Our abogados de accidentes de motocicleta handle crashes across Tampa Bay.

Accidentes de peatones y bicicletas

Arterials such as Dale Mabry Highway and Hillsborough Avenue carry high speed traffic through areas with heavy foot and bicycle activity. These cases turn on right of way, crosswalk placement, lighting and roadway design, which can bring a government entity into the claim alongside the driver.

Property owners owe visitors a duty to maintain reasonably safe conditions and to warn of hazards they know about or should know about. Tampa’s weather makes this a live issue year round. Storm season produces tracked-in water, leaking roofs, saturated entryways and debris that stays in place long after the rain stops, and a business that failed to inspect or address it is exposed. There is no permanent injury threshold here, so a fall claim can pursue pain and suffering from day one. Our Tampa slip and fall lawyers handle these, and you can read how casos de instalaciones están probados.

Seguridad negligente

A property owner can be responsible when a foreseeable criminal act injures someone because security was inadequate. Broken locks, unlit parking structures, absent security staff and ignored prior incidents all support a claim. Tampa’s entertainment districts, event venues and large parking facilities produce these cases regularly. See our práctica de responsabilidad civil de locales.

Negligencia Médica

Misdiagnosis, surgical error, medication and anesthesia error, and lesión de nacimiento all fall here. These are the most procedurally demanding injury claims in Florida, requiring pre-suit investigation, a corroborating medical expert opinion and strict notice steps before a suit can proceed, and they carry the pure comparative negligence exception described above. Our Tampa medical malpractice attorneys handle them across Hillsborough County.

Productos defectuosos

When a product injures you because it was designed badly, built badly or sold without adequate warning, the manufacturer and others in the distribution chain can be responsible without proof of carelessness. See our defective products and drugs práctica.

Lesiones catastróficas.

Some injuries require a claim built around decades of future cost rather than bills already received. Lesión cerebral traumática, lesión de la médula espinal and paralysis, amputation, severe burns and permanent disfigurement all fall here. These need life care planning and economic expert work, and settling early means settling for far less than the case is worth.

Muerte por Negligencia

When negligence kills, Florida’s Wrongful Death Act governs who may bring the claim, who may recover and what may be recovered, and it runs on its own timeline. Our abogados de muerte injusta handle these claims knowing the process is landing on a family in the worst period of their lives.

¿Qué indemnización puede recibir?

Daños económicos

The quantifiable losses: emergency treatment, surgery, physical therapy, prescriptions, future medical care, in-home assistance, lost wages, reduced earning capacity, property damage and out of pocket costs.

Daños no económicos.

Pain and suffering, mental anguish, inconvenience, loss of enjoyment of life, disfigurement and the effect of a permanent injury on your relationships and daily function. In catastrophic cases these frequently exceed the economic losses. Motor vehicle claims require the permanent injury threshold to be met. Premises, product and medical negligence claims do not.

Daños punitivos

Available only where there is clear and convincing evidence of intentional misconduct or gross negligence, with drunk driving the most common example. They punish and deter rather than compensate.

What should you do after an injury in Tampa?

  1. Reportalo. Call 911 after a crash, or file an incident report with the property owner after a fall.
  2. Busque atención médica de inmediato, and after any motor vehicle crash within 14 days.
  3. Fotografía la escena: vehicle positions and damage, the hazard that caused a fall, lighting, signage and your visible injuries.
  4. Recopilar nombres y datos de contacto for everyone involved and every witness.
  5. Pregunta sobre el vídeo. Surveillance footage is routinely overwritten within days unless someone demands preservation in writing.
  6. Notifique a su propia aseguradora, but give no recorded statement before speaking with an attorney.
  8. Contact an attorney before accepting any offer. Early offers arrive before the full extent of an injury is known, and accepting one ends the claim.

Preguntas frecuentes

¿Florida derogó el seguro PIP en 2026?

No. Florida still requires PIP insurance, and the no-fault system it sits under is unchanged. Senate Bill 522 and House Bill 769 died in committee, and the 2026 session ended on March 13, 2026 without a repeal. Drivers still carry the $10,000 minimum PIP coverage required since 1971.

No. The threshold in Florida Statute section 627.737(2) applies to motor vehicle claims only. If you were injured on someone else’s property, by a defective product or by medical negligence, nothing stands between you and a claim for pain and suffering.
